Another whopper
For the reasons which I have stated, the contention of the appellant that there was really no room for the operation of Lord Campbell's Act in cases of breach of contract because the law already provided a remedy in such cases, so that it could not be said that an action was not maintainable for damages in those cases, is a contention which should not be accepted..Woolworths v Crotty (1942) 66 CLR 603.
